"this is our territory. we can prove it and they can't and they are trying to steal." he warned that this type of treatment makes people feel that perhaps they should protect their borders through violence. "do you want to start a fight? someone is going to get killed over this." when smith said he did not know the history of our area or the sinixt nation, people at the meeting were surprised and disappointed. lawyer david aaron informed smith, "the way the provincial and federal governments are conducting themselves in negotiating away the territory of the sinixt is a historical pattern. it starts with disenfranchising them of their homeland just before the columbia river treaty and continues to this day." campbell added that the sinixt had spent 22 years fighting their extinction status. "we're facilitating a process that is political and without prejudice to other first nations. the claims put forward by the first nation are political claims, essentially. there is no verification done by anyone. they just have to prove they fit the definition of first nation." he said that there are many ways to deal with issues of overlapping territory in the treaty process. he said the two recently signed treaties contain "explicit language to deal with overlap" and added that "if there is any big infringement, there is an obligation on government to compensate, so i don't think it's reckless." smith said that during negotiations, "all parties try to find their way through this very complicated issue" of overlap. he said that to date, overlapping concerns have dealt with harvesting rights such as the right to collect clamshells, and the right to hunt and gather. these are non exclusive in the treaties, so other first nations are not excluded from these activities. he said there had been court applications from nearby first nations to stop the two recently signed treaties from being ratified, but they lost. he said it was the opinion of the treaty commission that the treaty process was much more effective than going to court. self-government and cultural protection are part of three treaties now, and are "big benefits, " he said. he agreed that the law has not been kind to first nations peoples.
